Website Development Terms & Conditions
These Website Development Terms apply to website design, development, maintenance, hosting and related services supplied by Bern Technologies.
1. Project Scope
The scope of each website project will be defined in the quotation, proposal or statement of work.
This may include website design and development, responsive design, WordPress, PHP or Bootstrap development, e-commerce functionality, forms, integrations, hosting, domain configuration, SEO setup, analytics, content migration and ongoing maintenance.
2. Client Content
The customer is responsible for supplying content required for the project, including text, logos, images, videos, product information, contact details, legal documents and other materials. The customer confirms that it has the necessary rights to use materials supplied to Bern Technologies.
3. Design Revisions
The quotation may specify a number of design revisions. Additional revisions or changes outside the agreed scope may be charged separately. Major changes to an approved design may be treated as additional work.
4. Client Delays
Project deadlines depend on the customer providing required information, approvals and content on time. Delays in providing these items may result in the project completion date being extended.
5. Domain Names and Hosting
Where Bern Technologies manages domains or hosting on behalf of a customer, the customer remains responsible for domain ownership, renewal fees, hosting fees, accurate registration information and payment of applicable third-party charges.
6. Third-Party Services
Websites may rely on third-party services, plugins, APIs, themes, hosting platforms or software. Bern Technologies cannot guarantee that third-party products will remain available, compatible or unchanged. Third-party licensing fees may be charged separately.
7. Website Launch
A website will be considered ready for launch once the agreed project scope has been completed and the customer has approved the website. Minor post-launch corrections relating to the agreed scope may be addressed within the applicable support or warranty period.
8. Intellectual Property
Unless otherwise agreed in writing, custom work created specifically for the customer may be transferred to the customer upon full payment; Bern Technologies retains ownership of its pre-existing code, frameworks, tools, libraries, templates, processes and know-how; and third-party software remains subject to its own licence terms.
9. Portfolio Rights
Unless the customer requests otherwise in writing, Bern Technologies may display completed website work in its portfolio, marketing material or case studies.
10. Maintenance
Website maintenance is separate from initial development unless explicitly included. Maintenance may include updates, security monitoring, backups, content changes, bug fixes, plugin updates, performance improvements and technical support.
11. Security
Bern Technologies will apply reasonable security practices within the agreed scope. No website can be guaranteed to be completely secure. Customers are responsible for maintaining secure passwords and access credentials.
12. Payment
Development work may require a deposit before work begins. The remaining balance will become payable according to the quotation or agreed payment schedule. Bern Technologies may withhold website launch, transfer or delivery where payment remains outstanding, subject to applicable law and the agreement.
